CloudFran Autopilot Product Addendum (Automated Outreach, AI Communications)
This Addendum supplements the CloudFran Terms of Service and is incorporated by reference into the Master Services Agreement. The Unified Payments + Marketplace Addendum also applies to payment-related features.
1. Scope
This Addendum governs the use of CloudFran Autopilot, including automated outreach via email, SMS, voice, and AI-generated communications.
2. Sender Responsibility
Users are deemed the sender of all communications initiated through Autopilot and are solely responsible for content, targeting, and compliance.
3. Consent and Compliance
Users must obtain and maintain valid consent in accordance with CAN-SPAM, CASL, GDPR, and TCPA prior to initiating communications.
4. AI-Generated Content Disclaimer
Communications generated by AI may require human review. CloudFran does not guarantee accuracy, legality, or appropriateness.
5. Opt-Out and Suppression
Users must honor opt-out requests and maintain suppression lists. CloudFran provides tools but does not guarantee compliance.
6. Fees
Transactions or communications tied to Autopilot workflows may include CloudFran platform fees (3.5% + $0.75 where applicable). Fees are non-refundable.
7. Chargebacks and Disputes
CloudFran mirrors payment processor protections, including $15 dispute fees where applicable. Users are responsible for associated losses.
8. Messaging Limits and Abuse
CloudFran may enforce limits, throttle messaging, or suspend accounts to prevent spam, abuse, or regulatory violations.
9. Liability
CloudFran is not liable for user communications, including regulatory violations, fines, or damages arising from outreach activities.
10. Data Usage
Communication data may be processed for analytics, personalization, and AI model improvement.
11. International Use
Certain communication features may be restricted by country and regulatory requirements.
12. Governing Law
This Addendum is governed by Delaware law with Georgia enforceability considerations.
13. Compliance
CloudFran aligns with SOC2, communications compliance, and audit readiness standards.
